Abstract

INDONESIA Sistem hukum syariat sampai saat ini masih digugat oleh sebagian orang terkait “kekurangadilan” dalam konsep pembagian warisan, dengan perimbangan 2:1 (dua banding satu). Perseteruan bukan hanya pada tataran konseptual, namun dalam tataran praktik juga masih menjadi tarik ulur antara hukum waris Islam dan hukum waris adat. Penelitian kualitatif ini bertujuan untuk mengekplorasi tentang tradisi pembagian waris, faktor yang mempengaruhi tradisi pembagian waris dan solusi dalam membumikan waris Islam di Gunungsari, kabupaten Lombok Barat. Data diperoleh dengan menggunakan wawancara dan observasi. Hasil penelitian menunjukkan bahwa, tradisi pembagian waris menggunakan lima metode, antara lain: 1) Pembagian harta warisan dengan memusatkan kepada anak laki-laki tertua; 2) Memusatkan ahli waris laki-laki sebagai pemegang kekuasaan penuh; 3) Harta warisan terbagi menjadi “harta mame” untuk laki-laki “harta nine” untuk perempuan dan laki-laki; 4) Pembagian dengan sukarela; 5) Pembagian harta warisan dengan menggunakan hukum waris Islam. Sedangkan faktor-fator yang menyebabkan tradisi pembagian, meliputi faktor budaya, keterbatasan pemahaman masyrakat, penegak hukum waris Islam yang kurang maksimal, materi hukum yang sulit dipahami masyarakat. Solusi untuk membumikan hukum waris Islam yaitu dengan sosialisasi kepada tokoh agama, pendidikan waris yang maksimal dan massif ke masyarakat, dan pengontrolan oleh pihak yang berwenang terhadap hukum pembagian waris di luar Islam. ENGLISH The system of Sharia in the concept of inheritance is still being debated by some people because of its “injustice” in the rule of the scale 2:1(two to one). The debate which concerns not only at the conceptual level but also at the practical one is still being a push-pull between Islamic inheritance laws and customary inheritance laws. This qualitative research aims to explore the tradition of heir division, the factors that impact on the division, and the solution in socialising Islamic heir in Gunungsari, West Lombok Regency. The data were o btained by using the technique of interviews and observations. The results showed that there are five methods which are used in the tradition of heir division, they are: 1) the division of heir which focuses on the oldest son; 2) focus on the male heir as the full authority; 3) the heir is divided into the heir of mame for men and the heir of nine for women and men; 4) voluntary division; 5) the division of heir using Islamic laws. While the factors that lead to the tradition of the division including the factor of culture, lack of the understanding of the people, law enforcement of Islamic inheritance that is not optimal, legal material that is difficult to understand by the public. The solution in reviving the Islamic inheritance is to socialise it to religious figures, massive and optimal heir education to the public and to control the laws of heir distribution outside Islamic law by the authorities.
