Abstract

INDONESIA Kebutuhan untuk melakukan rekonstruksi ushûl al-fiqh dan memperbarui pemahaman fiqh bukan saja didasari oleh kenyataan bahwa ushûl al-fiqh dan fiqh merupakan produk suatu zaman, tetapi juga oleh adanya tuntutan yang mendesak dalam konteks realitas kehidupan yang penuh keragaman. Tulisan ini mengetengahkan kajian yang apik tentang logika transformasi hukum, maqâshid al-syarî'ah. Kajian artikel ini menyebutkan bahwa maqâshid al-syarî'ah merupakan sumber dari totalitas hukum Islam yang pada tataran implementatifnya dapat dijadikan sebagai paradigma pengambilan hukum Islam. Oleh karena itu, sekiranya ada satu ketentuan hukum Islam baik dalam al-Qur'ân maupun al-Hadîth yang bertentangan secara substantif dengan maqâshid al-syarî'ah, maka ketentuan hukum tersebut mesti direformasi demi logika maqâshid al-syarî'ah. ENGLISH The demand to reconstruct the ushûl al-fiqh and to renew the understanding of Fiqh is not only based on the fact that both are the products of certain era, but also due to the provision of the urgent demand in the context of pluralistic society. This paper presents a thorough study of logic of law transformation, maqâshid al-syarî'ah. It is to advocate that maqâshid al-syarî'ah is the source of the totality of Islamic law, which in its level of implementation can be used as a paradigm of Islamic lawmaking. For this reason, should there be the provision of substantially contradictory Islamic law either in the Al-Qur'ân or Al-Hadîth against maqâshid al-syarî'ah, the stipulated law should be reformed for the logic of latter.
